FC of T 93 Application The important consideration as per the taxation rulings of MT 2027 has been duly stated under the sub-section 136 (1), which has duly stated about the use of assessment of the income based on the employee which shall be considered for the private usage. Despite of this sub-section 136 (1) is seen to be defined as per the operational valuation method for the business journey seen to be with the use of car and made in form of the employers associate. As per the paragraph 3 of the Miscellaneous Taxation Ruling the requirement of the logbook has been seen to be identical with the business kilometres travelled by the use of the operating cost model. The various depictions made form the case study has been able to highlight on the total distance of 50,000 km for work purpose. The determination of the fringe benefit for the vehicle has been further seen to be applicable with the cost valuation model which applicable under sub-section 136 (1) of the Miscellaneous Taxation Rulings of 2027 (Ta ylor et al., 2015). The critical question arises in terms of the determination of the private and business use. Henceforth, the car is used by the employee with the exclusive association of generating assessable income of the employee. This has been further seen to comprise of the assessable income which needs to be considered with the business activity required to produce the assessable income as per the sub section 136 (1). The course of employment with the employee has been considered with the FBT and the same might be considered for the business use. In addition to this, the car has been made to use with the course of business and the same is carried on by the employee for the use in business (Lin Flannery, 2013). As per the evaluated case Charlie has been able to made use of the car during the term of the employment and the sole purpose if it has been see with the business activities. It has been further discerned that Charlie has made use of the car, as per the assessable income of the employee and the same has been able to attract the FBT. The main test results has shown the use of tax evaluation for FBT purpose and the same is seen to be defined as per income tax laws in ascertaining the deductible regulations based on section 51 of the Income Tax Assessment Act 1997. Based on the different types of evidences the expenditure incurred by Charlie for the vehicle can be fully considered for deductions as the expenditure has taken place for the employment use. Hence, this can be completely considered as per the deductions of IT. The determination of the differences among the business use of FBT can be regarded for raising the question whether Charlie will be able to incur the expenditure as per the use of the car and the expenditure based on the present case of Charlie which will be regarded for the income Tax (Adebisi Gbegi, 2013). The consistency of the present study of the case has been taken from the guidelines as per Miscellaneous Taxation Rulings of 2027, this has been further seen to be establishes as per the IT principles. The various types of the rulings of the study have been seen with Sub-division F of Division 3, for the assessment of income tax in terms of depiction of the vehicle expenses which are incurred by Charlie and Homes and the same is deductible in terms of the income tax (Grantley Taylor Richardson, 2014). The rulings based on taxation rulings of IT 112, has been able to consider the decision held with the case of Lunney and Hayley v FCT (1958), which has been further confirmed with the various circumstance leading to the travel from place of abode to place of work and the same has been considered as per private ordinary travelling. The travel to the pace of employment is considered with the various types of the pre-requisite which is mandatory in depicting the income and the same is not considered with the income earned. Henceforth, the distance travelled by Charlie to the place of work shall be considered as private and the considered that Charlie has used the car as per the course of employment which would not cause any change in the projections. It needs to be further understood that the course of employment is considered to be itinerant. As per the case Newsom v Robertson (1952) 2 All ER 728; (1952), the cost of barrister in travelling the distance from place of abode to the place of work would included in the expenses. The court has been further seen to acknowledge the various types of the travelling expenditure from the place of abode to the chambers and this has not amounted to any expenses (Blaufus et al., 2014). Employment duties of an Itinerant Nature: The main nature of the employment has been seen to be taken into consideration as per the travel expenses of the employees and the nature of the unemployment which has been considered to be itinerant inherently. The reference with Simon in Taylor v Provan (1975) AC 194 has been considered with the travel of Charlie in regards to the employment travel formed in the portion of the work. Additionally, the employment travel has been based on the fundamental part of the work. Based on FBT Act 1986, Charlie has been seen to use the car for the employer which has been also seen to be based on the part usage of private use. The various cost consideration by Charlie has been further able to depict on the cost such as insurance, repairs and registration. Sketching, Black White, Pencil Sketches Essay Example

Sketching, Black White, Pencil Sketches Essay Sketching is a popular form of art wherein a person is able to create a freehand illustration/drawing using either a pencil or pastel. A sketch is not actually meant to be finished and is oftentimes made out of overlapping lines, making it look unpolished. In a more practical sense, sketching comes pretty handy when it comes to having a quick way of remembering and recording one’s ideas and thoughts. The art of sketching is also commonly thought of as having the ability to sharpen an artist’s concentration and focus. For students and professionals, sketching has been known to play an important part in a person’s artistic development.Take for example the sketchbooks of great artists such as Edgar Degas and Leonardo da Vinci wherein it is filled not just with creative sketches of their ideas, there are also meaningful insights showing that their sketches are not just mere drawings but there’s an important study behind it.Even in these modern times, the abilit y to record one’s thoughts through a quick sketch is thought of as a very practical skill which can be used in many modern-day situations. Examples of which are forensic sketches as well as courtroom artists who both play an important role in the fields that they specialize in.Pencil sketching is often used as an inexpensive way of putting an artist’s idea together. Through it, artists are able to reconstruct and redesign their work with ease and without wasting expensive materials such as paint. This method has actually been only introduced in the modern times already since people used to sketch using a silverpoint and a special kind of paper.Creating illusions through sketching can be achieved if one is skilled enough in shading and making the sketch seem realistic. This is wherein having the right tools as well as knowing how to use them properly comes in. Aside from pencils – which come in various kinds, erasers are also important in being able to get just t he right amount of shading for one’s work.   Art gum and hard rubber are two kinds of erasers that are commonly used for sketching and serve completely different purposes. Hard rubber erasers are usually used to practically clean up and sketch, taking out the errors made as well as the unwanted bits. Art gum on the other hand is the kind of eraser used for giving sketches their shading effects. These aspects make sketching a very favourable way of creating art, while it helps an artist record his or her ideas on paper it still gives him or her leeway   to make adjustments to his/her work just in case. When it comes to helping the sketch pop out, the artist needs to incorporate contrast in the colours and shading. Usually in black and white, sketches can be quite limiting when it comes to creating a dramatic effect but given the stark contrast of these colours, it provides a visually appealing effect. They equally make the other colour stand out. Learning how to blend is an other skill that needs to be learned when it comes sketching. This technique helps the sketch appear more life like as opposed to a typical drawing.

The RAP music culture essays

The RAP music culture essays Rap music as a musical form began among the youth of the south bronx, New York in the mid 1970's. Artists such as Kool Herc and Grandmaster Flash were some of the early pioneers of this art form. Through thier performances at night clubs and promotion of the music, rap began to become ever more popular throughout the remaining years of the 1970's. The first commercial success of the rap song "Rappers Delight" by the Sugar Hill Gang in 1979 helped bring rap music into the national spotlight. The 1980s saw the continued success of rap music with many artists such as Run DMC (who had the first rap album to go gold in 1984), L.L. Cool J and the Fat Boys. Today rap music still continues to be an important aspect of african-american music. When rap music first came about in america it was seen as a form of entertainment for youths in black inner city neighborhoods. Hanging out with friends and rapping or listening to others rap kept black youths out of trouble in the dangerous neighborhoods in which they lived. So basically the dominant culture did not have a type of music that filled the needs of these black youths so they decided to create a new style of thier own. Rap music originaly emerged as a way for the black youths to express thier everyday lifes and struggles. Rap is now seen as a subculture that, includes a large number of middle to upper class white youths who have grown to support and appreciate rap music. Many youth in america today are considered part of this culture because they share a common interest for a type of music that combines catchy beats with rhythmic music and thoughtful lyrics. Rap lyrics are about the problems rappers have seen such as poverty, crime, violence, racism, poor living conditions, drug abuse, alcoholism and prostitution. These are serious problems that many within the rap culture believe are being ignored by mainstream america. Those within the rap culture know ...

How we can reduce the nature deficit disorder among todays youth Essay

How we can reduce the nature deficit disorder among todays youth - Essay Example In this paper I will discuss in detail the nature deficit disorder that is prevalent amongst the youth today. In the earlier times, the most favorite and treasured time for children of all ages was the time they were allowed to play outside. This remained true, till the times machines took us over and now our lives and actions are invaded by electrically operated gadgets. They are better known as children of the digital age and have developed into more and more estranged from the natural world, with devastating implications, not simply for their bodily fitness, but in addition for their long-term psychological and spiritual heath as well. There are many causes behind this nature deficit disorder and children alone are not to be blamed. It is not the same safe world any more. Parents fear their children's safety and hence restrict them indoors (Tenenbaum). Sensational media reporting and obsessed parents have factually "petrified children away from the playgrounds and have confined them in front of their X-boxes and Play stations. While endorsing a controversial culture of apprehension that favors "safe and sound" restricted sports over creative engaging in recreation. Well-meaning basic school syllabus may educate students the whole thing there is to recognize about the nature and its vast spread beauty but the generation of the yester years was more sensitive towards it because most of them had spent their childhoods playing amongst trees and floating boats along river banks. All this seems to be a fantasy for the children today who would sit an enjoy some stranger's movie on you-tube instead of experiencing the fre sh air out of their rooms. And progress in expertise, while opening up an affluence of "virtual" familiarity to the young, has prepared them for children to expend fewer instances outside (McKee). By reducing pressure, whetting concentration, and encouraging original trouble solving, "nature-play" is also rising as a promising treatment for attention-deficit confusion and other early days problems. Indeed amplified contact to natural world may establish a salve for a lot of of the childhood disorders that at the present run out of control, the extremely ubiquity of those disorders is proof that two generation of estrangement from nature might have by now resulted in substantial damage to our kids. I believe that though children are said to be the direct victims of the nature-deficit disorder, it is not limited to the children alone (Tenenbaum). Infact it's a disorder that exists amongst the whole society; amongst parents who confine children indoors, amongst schools who have cut down on field trips due to safety reasons and so on. But one preliminary qualification must be made. Suppose we do discover certain significant deficiencies in the conduct of our young. Then the question will arise, where did they go wrong That question resounds of youth bashing. The better question is where did we, the current adults--or at least some of us adults--go wrong Our children's behaviors, for better or worse, largely reflect the demands and opportunities we adults provide them. Thus, the real issue is, how much are we adults willing to change to stimulate constructive changes in our young And what and how should we change YOUTH DISORDER Until a year or two ago,

Southern Stereotypes Essay Example for Free

Southern Stereotypes Essay Grotesque roams in the South whereby grace transformed into violence it becomes realization. In 1955, Flannery O’Connor wrote Good Country People, where she uses the distorted side of humans to aware the reader of the powerful reality of spirituality. Mostly the characters are used to represent grotesque. A female character in particular that O’Connor uses is Joy Hulga, a rather fanatical character who denies Southern stereotypes and is a â€Å"virgin ogre† who is a misfit. Southern belles are the way in the south that will have a place to fit. In this particular story O’Connor uses females to demonstrate a Southern social code. The society where these ladies are placed is one where a lot is expected. â€Å"The Southern Belle grows up (in genteel style), gets married (becoming a Southern lady), and like the larger American culture’s stereotypical woman, fulfills her highest destiny when she is wife and mother† (Pierce 1). Carramae has the attributes to truly be a southern belle who is a blonde that at age fifteen had come to be both a wife and a mother. Then on the other side her sister, Glynese an eighteen year old redhead with many admirers. Glynese wasn’t one to settle for crumbs she was worth a ’36 Plymouth and to get married by a preacher. Both â€Å"Glynese and Carramae are both fine girls,† (O’Connor 5) that any mother would be proud to be affiliated with and brag about and any man ready to escort such pretty ladies. â€Å"These Southern ladies are caricatures of normal girls who court young men, marry, and produce children† (Westling 518) representing the ways of a fine South. Unlike fine girls Joy Hulga denies the traditional Southern stereotypes of women. A common stereotype that O’Connor expresses is beauty within the exterior. Joy Hulga is always being compared to Glynese and Caramae and mostly because they are the belles while Joy Hulga is â€Å"a large blonds girl who has an artificial leg† (O’Conor 1). Joy Hulga has never fulfilled or fitted in a normal role or even danced, â€Å"any woman who fails to fulfill these roles is typically portrayed as either laughable, pathetic, or terrifying (and, in some cases, all of the above† (Pierce 1). She is now characterized as a thirty-two year old lady, whose life has passed beneath her eyes with no chance of a normal southern life converting her into a bitter egocentric person. She walks around stomping in a sluggish matter transmitting a depressing atmosphere. Aside from not having exterior beauty she has a Ph. D in philosophy. Any mother could brag about her daughter becoming a teacher but never a daughter who obtained a Ph. D. Due to the extent education she has she becomes an atheist. Since she thinks that she knows the truth about salvation, it brings herself into thinking she is superior than people because they haven’t opened their eyes to understand that there is no real salvation. â€Å"She looked at nice young men as if she could smell their stupidity† (O’Conor 3). Jo Hulga’s exterior and mindset juxtapose Southern life. Joy-Hulga’s very extensive character denies the Southern life who becomes a â€Å"virgin ogre† that is a misfit. O’Connor uses grotesque to establish characters creepy qualities. She has given Joy Hulga a distorted side to deny Southern stereotypes. It’s realism or just grotesque.

Case Studies Abstract

Case Studies Abstract Alfredo Cano Abstract Innovative methods in language teaching may sometimes be slightly difficult for less experienced teachers. Case studies are a relatively new type of task-based activities for business English students. They have been used in language courses for some time now. It seems, however, that their full teaching potential has not been used yet. Teachers seem to be uncertain of how to use cases in class. The paper presents the main pedagogical aspects of using case studies in business English courses. It gives a short description of the structure of typical mini-cases included in recently published course-books of business English. It discusses the basic principles and techniques of using the case study method in class. The main aim of the paper is to present the advantages of the case study method as a new tool of developing learners’ linguistic and non-linguistic competence.Cases offer valuable teaching material that needs to be fully exploit ed. Suggestions given in teacher’s books can be supplemented by various innovative tasks aimed at developing the productive skills of speaking and writing. Cases are motivating for business English learners since they give them the authority to decide what to do to solve a real-life business problem (learners are in the role of managers). Learners can present their point of view, discuss its advantages and suggest a course of action. They have a chance to compete and to demonstrate their analytical and managerial skills. Doing the cases learners use language naturally. In the case study method language is a tool to solving a problem, it is a means of communicating in typical business situations. If teachers learn how to use cases more extensively in the future, they will certainly make the teaching process more effective and studentcentered. 1. Introduction The effectiveness of language teaching depends, among others, on teaching materials.Students and teachers need materials that can improve the language acquisition process and offer more opportunities to develop the productive language skills of speaking and writing. These skills, as opposed to the receptive skills of reading and listening comprehension, are more difficult to acquire and require much more practice and time. In her book on business English teaching Donna (2000) stresses the fact that if students believe that in a language course they do tasks relevant for their future professional communication, they are more motivated to learn.Case studies were first used in law to evidence verdicts given by judges and to teach law students. In the 30s of the 20th century cases were introduced in psychiatry. Case reports were written to document diseases and to consult the cases with other specialists. Today, all medical specialties use case reports for didactic and research purposes. Case studies started to be used in business in 1967 when Strauss and Glazer created their ‘grounded theoryâ€℠¢. In the mid-70s of the 20th century they were introduced in business schools.Harvard Business School has been using this method intensively to teach future managers how to solve real-life problems. Today, the case study method is widely used as a teaching and researching tool in medicine, psychology, anthropology, sociology, economics, management, finance and other sciences where the presentation and analysis of a real problem is of relevance in teaching and researching. The paper presents the case study method as an interesting and motivating teaching material that can be widely used in teaching business English to adult learners. 2.

Movie Review The Single Blockbuster Hits - 1936 Words

Movies and the theater have been a long past time of people, but as technology and demand skyrockets, presentation of movies must change. The single blockbuster hits are in the past, as any substantially popular movie receives at least one sequel. Leading us to another problem, how to create and produce a continuous blockbuster series. At the forefront of this necessary revolution is Marvel Studios and their Marvel Cinematic Universe (MCU). Over the past decade the Marvel Cinematic Universe has revolutionised the way movie series and franchises develop and connect their plots to be successful. The shift in movie series productions is found in the way movies have been moving toward a less contained model to more free flowing interconnected†¦show more content†¦Pictured below is what became of the initial seven year plan to culminate to an Avengers movie with a superhero team up like never seen before in live action movies. Phase 1 consists of the development toward the origina l hope of the Avengers, using the origin-like story about each of the four main superheroes and a few short clips to do so. After Avengers was a blockbuster, Agents of SHIELD and Agent Carter debuted expanding the past supporting characters’ stories. Phase 2 expanded the universe further, introducing Guardians of the Galaxy in preparation for the galactic war planned for phase 4 (not pictured). Also in phase 2 were the sequels, in the case of Ironman the third installment, that would set the environment of the next Avengers movie Age of Ultron and develop the characters further. Age of Ultron amplifies the new theme of consequences that is developed throughout phase 2. Nevertheless, creating an apparent solution to the problems created just like any movie, this allows for the epic buildup of tension that explodes in Captain America Civil War after those consequences seem to be ignored. Phase 3 also contains the continuing setup of the galactic battle with Guardians of the Gal axy 2, and introduces the first of the second wave of superhero origins with Ant-Man. It is fair enough to say that this interconnection of movie plots is what the new standard for a production model is though there is an important second part to the model, which is theShow MoreRelatedNetflix : A Great Influence On The Home Entertainment Environment1232 Words   |  5 PagesProfessor Dumas Senior Seminar in Informatics Final Paper Draft 4/27/15 THESIS Netflix is revolutionary company operating in an incredibly dynamic industry populated by both longstanding and new competitors. Sexuality In Carol As Portrayed Through Mise-En-Scene And...

Sexuality in Carol as Portrayed through Mise-en-Scà ¨ne and Cinematography In Todd Haynes’s Carol (2015), silver bells and tinsel cover the walls and shelves of Frankeberg’s department store in the scene where main characters Carol (Cate Blanchett) and Therese (Rooney Mara) first meet. Through swarms of busstling holiday shoppers, Therese’s timid gaze lands on Carol - a strikingly beautiful, sophisticated, and self assured woman. As Carol’s gaze meets Therese’s, viewers sense an undeniable attraction. Throughout the film, and specifically in this scene, attention to mise-en-scà ¨ne and cinematography helps convey messages surrounding homosexual themes in the film. Intricate mise-en-scene plays with the characterization of Carol and Therese†¦show more content†¦Slight differences in her preferences and self expression coupled with her reluctance to join the masses in their Santa hats critically positions Therese s as different in this early scene. Meanwhile, Carol’s costume and performance paint her as simultaneously both more and less of an outsider than Therese. Establishing shots show throngs of holiday shoppers in dark wool coats and neutral colored suits, bustling around completing their holiday shopping. Then, the audience meets Carol. In an extravagant, caramel colored fur coat, a scarlet hat and scarf, and with fiery red lips and nails, Carol stands out from the crowd. Her slow, deliberate gaze contrasts the hustle of the shoppers. She is alone, while most other are accompanied by spouses, friends, or children, and she exudes an air of mystery and angst. Carol’s costume and mannerisms in this case align with Doty’s claim, however the classically feminine and glamorous way in which Carol presents herself complicates the connection. While Carol is in fact depicted as being an other, she aligns better with normative standards of female beauty and sexuality than all others in this scene. This notion is present throughout the film as Carol embodies the pinnacle of what women in this time aspired to exude; she’s elegant and witty, intelligent and compelling, beautiful and wealthy, and a wife and mother. However,

Policy Analysis Goals And Objectives - 1638 Words

Policy Analysis: Goals and Objectives The goals and objectives of the PRWORA was to end the dependence of welfare recipients on government benefits, increase the flexibility of states to administer welfare programs, and to prevent and reduce the incidence of out-of wedlock pregnancies and to encourage the formation of two parent homes, and finally to reduce welfare spending by the billions annually (United States. Congress, House Committee on Ways and Means, 1996). It seems that legislative assumed that all adults who are able to work and will if compelled to do so. Because of this assumption, legislation put a time limit on benefits, and after the time limit is up adults should be working and off public assistance. Services Delivered According to the Illinois Department of Human Services (ILDHS) the types of services TANF offers is cash assistance such as Supplemental Nutrition Assistance Program (SNAP). â€Å"SNAP helps low-income individuals and families buy the food they need for good health† (ILDHS). Most households with low income are eligible for SNAP benefits. Applying for SNAP benefits is relatively easy; Questions such as what is your gross adjusted income, how many children live in the same household as the individual applying for benefits, do you pay for child care, and which utilities do you pay for out of pocket? Once they have these questions answered, they calculate your responses, and that’s how they determine if an individual is eligible for SNAP benefits.Show MoreRelatedCriminal Justice Administration585 Words   |  3 Pagesas any other organization; the five elements are fairly basic. Bad law free essay sample

Bad law BY erik2408 Bad Law/Lawyers Introduction: Law is a term which does not have a universally accepted definition, but one definition is that law is a system of rules and guidelines which are enforced through social institutions to govern behavior. What is bad law you may ask? Bad law ties in with quite a few things, as a matter of fact its a very big subject but I would like to break it down to Just a few certain topics. The topics that I would like to discuss are what is and makes a bad lawyer in general, the morality of some lawyers. You could be a great lawyer but if you have horrible morals by my definition I would have to abel you as a bad lawyer. But my most important topic is on lawyers and ambulance chasing which is frowned upon. There are two great movies that explain both of these topics. We will write a custom essay sample on Bad law or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page One of the movies is My cousin Vinny which shows you an example of an overall bad lawyer. The other movie is a bit more popular The Verdict which portrays a morally bad lawyer that is an ambulance chaser. Discussion: Lets get started! The first thing Id like to discuss is a bad lawyer Just in general. I dont know if a lot of people seen the movie My Cousin Vinny but that movie is a great example of a bad lawyer. For the people that are unfamiliar with it let me tell you a little bit about it. The movie starts off by two boys driving across the country and get arrested and trailed for murder, for the killing of the clerk at a gas station they had Just been into. The two boys were innocent and but there were witnesses saying they saw them. They were broke and in big trouble. So one of the boys called his uncle Vinny who was a lawyer. This was Vinnies first case ever as a lawyer and was completely clueless. Vinny did not know the rules and regulations on how to behave in a courtroom to say the least. Somehow he convinced the kids to let him represent them. Vinny was learning as we went along, and with the help of his girlfriend he actually won the case. But if I was being trailed for murder I for sure know I would not want him representing me. If you are in need of a lawyer heres some tips you may need to know to avoid the bad ones. For one dont go for a general practitioner when you need a specialist. Two, do some legwork to find a good attorney. Three, dont sign up unless youre completely comfortable with the fee arrangement and relationship. Four, understand what an attorney is doing for you. Last but not least be wary of the slam dunk claim. Any lawyer who says you got a slam dunk case is not a very good lawyer (Collins). Hopefully that information gives you a better understanding ofa bad lawyer. Now to talk about my main issue, which are lawyers with bad morals. What do I consider a morally bad lawyer? An attorney that is an ambulance chaser would be considered a morally bad lawyer in my eyes. An ambulance chasing is a form of barratry, refers to a lawyer using an event as a lawyers that follow ambulances to the emergency room to find clients. Ambulance chasing is prohibited in the US. Such conduct violates Rule 7. 3 of the American Bar Association Model Rules of Professional Conduct. Some bar associations strongly enforce rules against barratry. For example, the State Bar of California dispatches investigators to large-scale disaster scenes to discourage ambulance chasers, and to catch any who attempt to solicit business from disaster victims at the scene. Ambulance chasing is also illegal in Australia, in accordance with clauses 20 and 22 of the Legal Profession Regulation of 1987 (Wikipedia). Lawyers arent supposed to solicit their clients directly, at least in theory (Toothman). But of course that would be in a perfect world, but as right now the reality is that there are always some lawyers cutting deals with ambulance drivers, nurses, and funeral homes so on and so forth just to get tips on finding victims that might have a legal case (Toothman). When theres a big event, like an explosion or a train wreck or even a bus crash, how do the random victims find their way to the hungry lawyers? In the good old days, plaintiff lawyers chartered planes to fly to Bhopal, India, for example (Toothman). In Toothmans article he writes about Lawyers fake press release to sign up clients. What these lawyers did was send out a bizarre press release, announcing that, without even having a single client so far, they are investigating or looking into the disaster du Jour, which they have ripped from the headlines (Toothman). Du Jour is a magazine by the way. That wasnt intended to get a local paper to run a story about that, the goal was to reach out to any victims or their families who might be looking around for hope, or a lawyer, will stumble upon these press releases using Google or yahoo and rush to sign up with the hungry lawyer (Toothman). In other recent rticles about ambulance chasing an attorney in Texas was arrested for doing this. The event took place in May of 2012 only a year and half ago. Ronald Reynolds was a state representative and former municipal Judge. He was arrested for barratry which is a fancier term for ambulance chasing. Texas, its not Just prohibited by legal ethics rules its also flat out illegal (Rabiner). This was such a widespread problem at the Harris County Courthouse near Houston, officials recently erected signs warning attorneys that barratry is a crime (Rabiner). The legislator was caught soliciting otential clients soon after they had been in car accidents. It was also reported that he founds some clients with the help of a local chiropractor. This is something you would not expect from a state representative. Its very sketchy and illegal in the state of Texas which I did not know until reading this article. In Texas, attorneys arent permitted to send unsolicited offers of representation until 31 days after the underlying incident. Or when they know the individual already has legal representation (Rabiner). In addition to breaking these rules, the District Attorney has also accused Rep. Reynolds of tricking an undercover investigator he never met into signing an attorney-client agreement that gave him part of any settlement. Any settlement included insurance monies (Rabiner). What I found to be humorous in the article was the Rep. Ronald Reynolds even voted for the barratry law back in 2011. You would think someone who votes for a certain law would not be dumb enough to break that very law. Especially someone with a stature of being a state representative. I was appalled and in shock after reading this how can somebody be I was unaware that ambulance chasing was so common, I ran into another article here a lawyer was accused of offering kickbacks to two local insurance agents for referring accident cases to him, challenging the legality of the state statute that makes such practices a crime (Smith). Scott Jeffrey Jontiff, 33, of Miami, was charged with two counts of unlawful solicitation by an attorney after insurance agents he contacted turned him in to the Florida Division of Insurance Fraud in West Palm Beach (Smith). It was stated in the police report that there was a recorded and videotaped conversation where Jontiff offered to give the insurance agents $100 for ach personal injury case referred to him or $1 50 if the agents waited until the insurance companies paid up (Smith). The charges that Scott Jeffery faced were 3rd degree felony which is punishable by 5 years in prison and 5000 dollar fine. What I dont understand is why put yourself in such danger by committing such a crime to me it seems stupid. Youre eventually going to get caught sooner or later. To get a better understanding on ambulance chasing and actually have a visual aid I strongly recommend watching the movie The Verdict. The Verdict came out in 1982 its an ld movie but very popular back in the day and still is, and yes its in color. The movie portrays a lawyer who is down-on-his luck, reduced to drinking and ambulance chasing. The down on his luck lawyer is Frank Galvin. Former associate Mickey Morrissey reminds him of his obligations in a medical malpractice suit that he himself served to Galvin on a silver platter (The Verdict). All parties were willing to settle out of court, until Frank suddenly realized that perhaps after all the case should go to court, to punish the guilty and get a decent settlement for his clients, nd to restore his standing as a lawyer (The Verdict). Conclusion: Bad lawyers are not Just in movies are not Just in movies. As you can see by the few example articles that I talked about ambulance chasing is a real thing and happens more often than you think. It practically happens on a daily basis there are always lawyers or somebody out there trying to take advantage of you. As I read in a few articles ambulance chasing attorneys are viewed as bottom chasers, theyre not very well liked. The Verdict does a really good Job portraying an ambulance chasing attorney. Those types of lawyers are always trying to get a lawsuit on something to get an easy buck. When you go as far as go to funerals and such right after a family has had a death in the family to try to catch a case in my eyes thats having low morals and its frowned upon. As far as having a bad lawyer in general you Just have to be careful on that and take all the necessary precautions to avoid them. The tips I stated above are a few helpful hints to spot a bad attorney. As society grows and changes I hope lawyers wont be as hungry and try to have a little sympathy for others and reevaluate their morals.

Research in Business The Turbulent Environment

Question: Describe about the Research in Business for The Turbulent Environment. Answer: Introduction The turbulent environment in a company can be defined as the change that occurs in the business process due to the change in the external environmental condition. The environmental turbulence can have a huge impact on the internal condition of a company. The change in the external market can occur due to many reasons like global recessions, financial crisis and unemployment. An enterprise can face huge financial loss due to the impact of the turbulent environment. Hence, the turbulent environment can damage the performance of the organization. Chan Cui (2016), stated that the negative effects related to the turbulent environment can lower the reputation of the company. In the modern age of business, rapid change in the business environment is highly common phenomena. The change that occurs in the external environment due to turbulent is of uncertain and unpredictable in nature. Hence, it is highly challenging for the management of an organization to deal with the changes. The small and the medium scale industries are affected worst due to the effect of turbulent change. According to Eden Ackermann (2013), it is difficult for a company to characterize the nature of the turbulent environment and thus preparing suitable plan to deal with these situations is challenging. The company needs to do extensive research work from a different context to make the best use of the situation that has led to the turbulent environmental condition. The socio-economic condition is one of the best ways that can be adopted by the company to make effective strategic planning. The companies also need to make economic planning avoid financial loss due to the unpredicted business condition. According to Dibrell, Craig Neubaum (2014), a business organization need to have effective strategic management planning to minimize the adverse effects related to the turbulent environment. Flexibility in the planning process of a company can help to deal with the changes that occur in the external business environment. In spite of the fact that it is difficult to predict the changes that occur due to turbulent environment, it is crucial to prepare contingency plan for the unfavorable scenario. One of the most important characteristics of every successful enterprise is to predict these unfavorable conditions ahead of their business rivals so that it is possible to minimize the financial loss. Moreover, it is also necessary to respond faster and even try to make best competitive advantage of the situation. The high-performance rate and effective planning of the large scale business firms are the keys to avoiding the adverse effects that are associated with the turbulent business environment. The managers of the company need to have effective decision-making skills to make effective planning during the time of crisis (Wolf Floyd, 2013). With the help of strategic planning, it is possible to make critical planning during the time of turbulent environment. Problem Statement The globalization is one of the most commonly occurred phenomena in the modern day business. However, due to the globalization, the small and medium scale industry faces huge problem due to the stiff level of competition. The demand of the consumer changes vastly due to the introduction of innovative marketing strategies. The frequent changes in the international business environment are the main reasons for the turbulence. McDonald (2013), believes that this turbulent business environment is mainly responsible for the failure of the small and the medium scale industries that are trying to establish their brand name in the international market. The multinational companies are also facing huge financial loss due to these crisis situations of the market. Hence, these companies are forced to reduce the total number of workers, thereby leading to the problem of unemployment. The rapid rate of progress in the technological world is also causing the huge change in the international business. In spite of the fact that the technological revolution is helping in the expansion process of international business, on many occasions, they are associated with turbulent environment condition. The turbulent environment can be of different types depending upon the nature of and origin of change. External forces like political, economic, ecological, legal, infrastructure and technological factors are mainly responsible for these turbulent environments. The main challenge that is associated with the turbulent environment is that it is nearly impossible to predict this external environment and hence, the small and medium scale industries can never prepare the continence plans. Moreover, the workers in the companies may not be prepared to accept the change in the policy that is implemented by the management hence; they are not able to perform to their best capability. This, in turn, can lower the performance level of the company. Research Objective and Research Questions The main aim of this research project is to investigate policies adopted by high performing business organizations to deal with the turbulent business environment. These strategies can be implemented by small and medium scale industries to minimize the adverse effects related to the unfavorable turbulent environment. Moreover, it will help the business firms to predict the future unfavorable business environment with high level of accuracy. What is the strategic management process of high performing business firms to deal with the unfavorable turbulent environment? How can the small and the medium scale industries prepare for the turbulent business environment? How is it possible to predict the turbulent business environment with high level of accuracy? What planning is necessary for newly developed firms and startups to avoid the adverse effects of unfavorable business environment? Justification of the Research Project Channon Jalland (2016), believes that the corporate level strategy planning can be highly effective to deal with the turbulent business environment. It helps an organisation to evolve by adopting the cognitive representation of the competitive environment of the firm. It also helps in the evolution by shifting the balance of the company at the organizational level and thereby increasing the dynamic strategy of the company. The long jump strategies at the corporate level are highly effective to deal with the unpredictable changes. The corporate planning can also help in the process of organizational architecture. This helps to develop the corporate framework of the company and thereby assist in the process of coordination among the employees. The effectiveness of the corporate level of planning to deal with the turbulent environment has been a matter of great debate. According to Mitchell (2013), the corporate strategy can have a negligible effect to neutralize the adverse effects related to unfavorable business conditions. Nevertheless, with effective planning, it is possible for large-scale corporation to make the best use of any unpredicted adverse situations. The turbulent environments in the large scale enterprise are mainly characterized by the high level of complexity, dynamism and uncertainty. During the time of turbulent environment the company is not able to meet the demand of their clients and hence have to compromise the level of client satisfaction. However, the strategies that are prepared by large scale Business Corporation are highly effective to deal with the turbulent environment and additionally gain competitive advantage. The main purpose of this research is to understand the cause of the turbulent business environment. This will help the small and the medium scale industries to make contingency plan and thereby better preparations for all unfavorable external business environment. Strategy formulation is one of the main reasons for the high performing business firms are able to discover innovative techniques to deal with the turbulent environments. It is important for the business firms to lower the level of uncertainty with the help of better prediction power. The final report of this research work will help in the framing of the strategy that is effective in the turbulent environment. The success in the modern business is highly dependent on the capability to predict the coming of turbulent environment (Peppard, Galliers Thorogood, 2014). Therefore, prediction of these conditions is crucial for all business companies. This can help an enterprise to gain competitive advantage over the rivals. The r esult of this research work will also help to measure the level of turbulent and also identify the underlying reasons for them. Expected Outcome of the Research The outcome of these research works will help to understand the reasons for the occurrences of the turbulent business environment. This will ultimately help the small and medium-sized industries to make effective strategy planning for improving the business performance during unfavourable external business environment. The research will also be able to highlight how the large scale companies implement strategic planning to overcome the adverse business conditions. The outcomes of this research will help to fulfil all the objectives and provide answers to all the research questions. The result of this research will help the newly formed business firms and startups to make effective planning for the adverse business conditions and make the best use of the turbulent environment. Research Methodology According to Bergh Ketchen (2011), selection of appropriate research methodology aligning with the particular research study helps to conduct a research systematically and ethically. In this research, the researcher would undertake appropriate research methodology based on the research aim and objectives. The author, while conducting this research would incorporate the following components of research methodology: Research Philosophy According to Bernard (2011), epistemology is one of the important branch of philosophy, which includes positivism, interpretivism and realism. The positivism philosophy supports the assessment of available primary data based on the existing evidences, facts and true facts recorded. In contrast, interpretivism philosophy supports human perception, which influences the researcher to deal with the research issues based on self-perception in a particular situation (Harrison Reilly, 2011). I contrast to these two theories, the realism philosophy is a perception that depict, the reality related aspects could be independent from the conceptual aspects or perceptions in a ontological way. Based on the research objective, which includes the investigation of high performing firms presentation in a turbulent business environment, the researcher would select the positivism philosophy to be suitable for this study. It is because, with the help of this philosophy, the author would be able to unde rtake logical and critical investigation on the business performance of the firms. Research Approach There are two types of theoretical underpinning or research approach, i.e., inductive and deductive approach. Pickard (2012), claimed that inductive approach is crucial for the research work, when there is a need for the establishment of new theories according to the research issue. It helps the researcher to gather information and themes related to the research topic, and at the end of the study, a theory or hypothesis if being established. On the other hand, deductive approach helps to gather primary empirical data from the research field and analyze them with theoretical underpinning and literatures already existing on the research topic. In this context, this study would explore the firms performance in turbulent environment. Thus, investigating through primary data collection would be more effective, than establishing new hypothesis in this domain. Therefore, deductive approach would be suitable for this study, compared to the inductive approach. Research Design Selecting the research design is very important, because based on the research design, the data collection method, type of sample and the research strategy is selected (Lichtman, 2012). Therefore, it is important to select the appropriate research design, based on the research aim and objectives. There are three types of research design; explanatory design is implemented when the cause and effect relationship is being established within the research variables, the exploratory research design helps the researcher to gather the peripheral information to build up knowledge on the research topic. In contrast, the descriptive research design helps the researcher to stress on the assessment of associations between uncontrolled, dependent and independent variables, while analyzing the factors affecting the research variables. Here, the researcher would select the analytical or descriptive research design, as this research design would allow the researcher to carry out the research process w ith different paradigm, focusing on different variables. This design also allows the use of mixed data collection method, including both quantitative and qualitative methods (Crouch Pearce, 2012). Data collection method and research strategy Selection of appropriate data collection method enhances the accuracy and efficiency of data analysis method and potential to gain expected research outcomes. For the primary study, there are two types of data collection methods, including the quantitative and qualitative data collection methods. The quantitative data collection method includes the collection of numerical data, whereas the qualitative data collection method includes the collection of descriptive data with in-depth information, whereas a mixed data collection method involves both quantitative and qualitative data collection method. Based on the research objectives, the author would select the mixed method of data collection, which would involve both quantitative and qualitative data collection (Erickson, 2012). Based on the data collection method, the research strategy is being selected. Within several relevant strategies for the primary research, the researcher would select survey and interview strategy for this research. Both of the research strategies are suitable for this study. The survey strategy helps the researcher to collect the numerical data, which can enrich the research by incorporating wide range of numerical information. Through a series of survey questions, different themes would be revealed, based on which the analysis would be done. 50 employees of a high performing firm in Australia would be surveyed by providing online survey questionnaire and feedbacks would be collected in the same way. The questions would include the companys strategies and competitive aspects, as well as the factors promoting the strengths. In the questionnaire, there would be 5 options against each question, following the five-point Likert scale, where 1= strong positive effect and 5 = strong negati ve effect. On the other hand, for collecting the qualitative data, 5 line managers of a high performing organization in Australia would be interviewed. It would provide descriptive in-depth data, which would be helpful for understanding the perspectives of managers about the firms competence and their contribution to the firm's performance. In this context, managers would be able to express their experience in the organization and the factors that are contributing to the organizational performance in turbulent environment. Data Analysis Method Two types of data analysis methods would be used in this study, the quantitative analysis and qualitative data analysis method, for the quantitative and qualitative data respectively. The quantitative data would be obtained in numerical form, thus, the statistical analysis would be done in this case and the findings from the data analysis would be represented in graphical and tabular form; these would include excel sheets, pie charts and figures (Crowther Lancaster, 2012). For quantitative data analysis, descriptive statistics is used, if required, where the mean, median, mode and standard deviation of the collected data are done, to enhance the reliability of the data findings. In contrast, for analysis the qualitative data collected from the managers interview, the statistical methods cannot be applied, as the information or data collected from the method would be descriptive, instead of being numerical. In this case, the managerial transcripts would analyzed by thematic analysis, where different themes would be identified from the managers opinion and these would be analyzed with the pre-existing data in related literatures. Ethical consideration According to the Data protection act 1998, the researcher need to follow all the ethical considerations important in the research work (Miller et al., 2012). In this context, the researcher would allow the complete freedom to the participants about the participation in the research work. on the other hand, the researcher would ensure that all the personal and professional information collected from the participants would be kept confidential. In this regards, the researcher would not use any of the the important information from the participants in any other work except this research. In addition, the participants would provide an information sheet, where all the important aspects of this research would be clearly stated along with the role of the participants in the research (Creswell, 2011). The participants would not be asked any kinds of questions, which is not related to the research work. The mixture of all the above methodologies would be undertaken by the researcher to get the expected results related to the research problem. Selection of appropriate research methodologies would be helpful for the researcher to conduct a potential research study. Organization of the study The study would be organized in the following manner: Gantt chart Task Start Date End date Duration (weeks) Proposal 1/11/2016 14/11/2016 2 Literature Review 15/11/2016 14/1/2017 8 Data Collection 15/1/2017 14/3/2017 8 Data Analysis 15/3/2017 14/4/2017 4 Final Submission 15/4/2017 14/5/2017 4 Project Budget and Budget Justification Setting a fair budget is important for the research. In this research, for primary data collection, the budget would be decided considering all the necessary resources (Bernard Bernard, 2012). Based on the data collection methods and the other requirements. It has been estimated that around $4500 would be required for competing for the study within the given timeframe according to the proposed research organization. For collecting the primary data, arrangement of online survey and feed collection, posting and mailing cost are included in the budget. On the other hand, to arrange the managers interview, recording and other staffs would also require financial resource. The budget for both the quantitative and qualitative data collection would require around $2500. The proposed budget can vary slightly if there is a change in sample size, which would only be decided, once the access to the participants are obtained. In addition, the analysis of the would require the access of charts, t ables, figures from the government websites and hard documents. It would cost around $1000. Finally, for the thematic analysis of the qualitative data, a thorough review of existing literature would be required, which would also need allocation of some costs. It would include the literature search from the reliable search engines and libraries. This would cost around $700. For accessory requirement, $300 would be allocated. Therefore, in summary, the budget would be: Purpose Estimated Budget Data Collection $2500 Data Analysis $1000 Literature Review $700 Others $300 Reference Bergh, D. Ketchen, D. J. (2011).
